J & A 6.302-1(a) The is a notification that the Internal Revenue Service (IRS) intends to award on a sole source basis a firm fixed price delivery order to Digital Audio Corporation d/b/a Salient Sciences to procure brand name Video Focus Software and Cardinal MiniLab Advanced Suite, accessories and software support via GSA Schedule 70, SIN 58-1 under NAICS code 511210. This is an Internal Revenue Service Criminal Investigations requirement in connection with our joint case work with other federal law enforcement units to support criminal trials.

The Delivery Order shall be issued to Salient Sciences d/b/a Digital Audio Corporation via GS-03F-036BA. Salient Sciences, A Division of Digital Audio Corporation is located in Durham, NC and is the sole proprietor and reseller of the required products. The statutory authority permitting other than full and open competition is Section 303(c) of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act [41 U.S.C. 253(c) (1)], implemented under FAR 6.302-1(a), which authorizes other than full and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements.

The period of performance is one year. This is not a solicitation for proposals or an invitation for bids. The Government does not anticipate receiving responses to this notice of a non-competitive action.

Based on the above, the justification is certified as complete and accurate by the technical requirements personnel to the best of the technical personnel and the Contracting Officer's knowledge and belief.
