The article asserts that legal actions taken against Bayer regarding these oral contraceptives have had a tremendous impact on the company, causing the earnings of the pharmaceutical division to fall by 43.3 percent in 2012 due to the need to reserve over $1.5 billion for legal claims. To date, Bayer has paid an estimated $1 billion in fees associated with settlements regarding approximately 4,800 individual claims. These cases are undergoing review by the company one at a time and it asserts that 3,200 unsettled claims that are related to Yaz and blood clot injuries remain to be concluded.
The legal troubles that Bayer is facing stem from 2009, when the company was first said to fail to warn consumers regarding the blood clots and other side effects related to the use of its products. After reviewing multiple studies, the FDA required the safety labels of the contraceptives Yaz, Yasmin and Ocella to be revised.
